Is Sharkguard™ legal?

Yes – Sharkguard™ is legal to install, but regulations can differ between states and territories. It’s important to ensure your specific fence setup complies with local laws and council requirements.

Quick guide for installing fence spikes legally in Victoria:

✔️Fence location

If your fence faces a public street or open space, make sure it’s either:
– Set back at least 150mm from the boundary, or
At least 2 metres in height

✔️ Check with your council
If your fence faces a public footpath or you're in a built-up area, you may need council approval before installing any deterrents.

✔️ Do I need a licensed installer in Victoria?
For residential properties in Victoria, you generally do not need a licensed installer to add fence spikes, provided the installation is straightforward and not part of an integrated electronic or high-security system.
However, you do need to ensure that:
—The fence complies with local building regulations (e.g. height, setback from public space).
—The spikes are safely and securely installed, posing no undue risk to the public (especially if near a footpath or shared boundary).
—You're not breaching any council planning overlays, such as heritage or zoning restrictions.

✔️ Put up warning signs
You still owe a duty of care, even to trespassers. That’s why every Sharkguard™ panel includes a warning sticker, and we also offer additional signage you should use externally to increase visibility warnings of spikes and protect you legally.

✔️ Got a shared fence?
If your fence is shared with a neighbour, you’ll need their consent before installing any spikes to avoid legal issues.
